Posting of negative comments in the Gunshop section could bring unwanted criticism on the forum, having said that it is important to let members know if dealings with a Gunshop were less than ideal for you. To that end we will allow what will be known as the 'Scotsgun Ruling'
The Scotsgun Ruling:
>Add Gun Shop here<
"As I've yet to have a 'positive' experience there, I'll refrain from commenting further."
Beyond that please take it up with the Gunshop, if you do resolve the issue in a agreeable manner let us know!

Re: Any solicitors/ legal advisors?
As Sim correctly says it IS public record information and as long as the FACTS are reported there is naff all he can do. Even if a journalist wrote a load of tosh it is unlikely he could do anything (yes I know there are laws but lets stick to real life).
A wee story about a dealer being sued for dodgy goods is "public interest".
Of course he could then close the doors and re-open and artiglo's claim would go out the window. Keep on pushing for a result, these things surely have time limits for things to happen do they not?
Again, as long as it is FACTUAL, i,e he was done under a legal claim there is no reason why THAT cannot be posted here, is there?

Good morning ladies and gents,
Many thanks for the words of support, though I felt that my post was well within the law, the "gentleman" named felt otherwise and contacted the forum mods asking to have it deleted. As I said previously I have no problem with this the forum is a pleasant place to post and read others opinions and long may it continue, the last thing I wish to do is draw unwelcome comments to the board.
The mods were kind enough to inform of what was happening and tell me that at the time the posts were removed the scans of the judgement had been downloaded about 90 times so job done. Should there be anyone in any doubt they need only pm me asking for clarification.
I spoke again to the EJO ( enforcements of judgements office) this morning and apparently the file is still in the system, so I'll chase it up in a months time and see if there is any progress. On the bright side all I need to do is keep chasing the EJO which takes just a few minutes on the phone so all the hard work is done from my side.
I'll update as and when anything transpires.
all the best phil

Follow up your phone call with a chase up letter, recorded delivery...keeps them interested. And gives you a record if it "times out" or gets lost or whatever.

Re: Any solicitors/ legal advisors?
Good evening ladies and gents,
This is more of a heads up than an update, the gentleman in question currently has a couple of f open rifles for sale, on the bright side it may mean he'll settle the judgement against him, though still won't be holding my breath.
As regards the action by the EJO to bring things to an end, "my man " is dodging and weaving to great effect and to date paid nothing.
If the current enforcement action is unsuccessful, it would appear that the courts next move would be to serve a payment order on him ( monthly amount set by court) failure to make any of the payments results in an automatic warrant for arrest and imprisonment and the payment would still be due.
More news as and when it arrives.

Re: Any solicitors/ legal advisors?
Just seen this- yer man cannot hide behind the law of defamation if he has been found against in a court of law. If an Rfd is selling dud barrels as new, and has lost a court case based on that fact, then there is a clear public interest. The court judgment is a matter of public record, as any good reporting based on that judgment would be. Will send a pm tomorrow when Im not on my phone.MiLisCer wrote:Perhaps Gaz could write up the "facts" in his section for all to see - he is after all a journalist and he will be just reporting the facts? - worth sending him a PM

Re: Any solicitors/ legal advisors?
Morning Chuck,
I'm currently still at work and have been unable to contact the enforcement officer in charge of the case ( despite repeated emails and phone calls). I get home later this week and will chase it up and post a further update. I have been contacted by another dissatisfied customer of " my man" who claims to have paid a substantial deposit for a rifle and has been trying to get his money back after the rifle failed to be delivered as promised.
As I posted previously he's been advertising a couple of fclass rifles based on " defiance machine actions" and various other shooting related items. I posted a reply to one of his adds on another site and the add and my post were deleted, I tried contacting the forum moderator but did not receive the courtesy of a reply.
Hopefully some more news later in the week.
Regards phil

Re: Any solicitors/ legal advisors?
Morning Ladies and Gents,
Managed to get hold of the enforcement of judgements office (EJO) in norhtern ireland today and as expected really just a waste of a phone call.
The most recent stage in the procedure had been the issue a while back of a seizure order against " the man's" rifles and shooting equipment, the officer tasked with this is also an experienced tr shooter, and things at that point looked a little more promising. However "my man" has been running rings around th authorities had nothing of value on his personal cert and there is no official record of "his"rfd holdings (though it does not seem that any attempt was made to question "him" on this subject, in addition there is a suspicion that "he" also held rifles on a republic of ireland ticket.
then "my man" advertised 2 fclass rifles and associated equipment for sale on a couple of fora/sites, I promptly forwarded these adds to the EJO, foolishly believing this would help my case. apparently this information was either not passed on or ignored and the enforcement officer claims he returned the file to the office at the expiry of the seizure notice. The file it would appear has languished peacefully in the office ever since.
The case manager has promised to look into it and get back to me.
More to follow, all the best phil

Re: Any solicitors/ legal advisors?
go round to this guys place and fill him in ! then see how much interest the ejo and the law takes? this kind of s*** makes me sick , what is the matter with our legal system? it almost seems like they want to help criminals?
Re: Any solicitors/ legal advisors?
Tackb,
The whole problem in this instance is that its a civil matter and as such no one really cares, my view now is that you get lots of sensible advice and help and a system that would work if you were dealing with a normal person. But dealing with someone dishonest the system just falls over and gives up. The mans a streetwise dishonest turd and will most likely get away with it. He's been selling other bits and pieces and some people are happy, unfortunately I and others have not been so lucky.the only bright point to the whole mess is that I've shouted loud and clear that the man is untrustworthy and hopefully saved a few others a similar experience.
In addition I also found out today that to move things further forward will incur additional cost on my part for probably little return, so much as I hate to say it, its time to let things run to a conclusion and if unsucessful call it a day. Eventually he'll get his comeuppance.
